Website Terms and Conditions for the Brothers1906 Organization Online Store
General
the website https://brothers1906.org (hereinafter: "the Site") is an internet site that includes an online store for selling products and services to consumers in Israel (hereinafter: "the Products"). The owner of the site and its operator is the Brothers Symbol Non-Profit Organization, registration number 580573657, located at 8 Hashmabir Street, Tel Aviv (hereinafter: "the Operator").
The provisions of this agreement shall apply to any action you take on the site and shall constitute the legal basis for any matter between you and the Operator. Accordingly, you are requested to read this agreement in full and carefully. Browsing and/or any action on the site constitutes your agreement to accept and abide by the terms of this agreement. Therefore, if you do not agree to the terms, you are requested not to use the site.
It is emphasized that any person performing an action on the site declares that they are aware of the site's terms and the additional guidelines and conditions appearing on the site, and that they and/or anyone on their behalf will have no claims or demands against the Operator, the site operators, or those acting on their behalf.
The Operator reserves the right to change the terms of this agreement from time to time at its sole discretion without the need for prior notice or notification.
The user agrees that the computer records of the Operator regarding actions performed through the site will serve as prima facie evidence of the actions.
Photographs and/or drawings of the products displayed on the site are for illustration purposes only and do not obligate the Operator or the site operators or those acting on their behalf. It is agreed and clarified that the Operator will make a reasonable commercial effort to present accurate photos and data about the products to users of the site. Any error in the description of any of the products will not obligate the Operator. The color catalog on the site is for illustration purposes only, and there may be differences between the colors displayed on the site, some or all, and the colors actually sold. Any error in the color description and/or appearance of the color and/or how the color appears on the user's screen will not obligate the Operator.
The Operator is not obligated to maintain inventory of all the products whose images appear on the site.
The Operator will make every effort to ensure that the information displayed on the site is the most complete and accurate, but it is clarified that inaccuracies or errors may appear, and the Operator or those acting on its behalf will not be liable for any consequences arising from or related to them.
The Operator reserves the right to update the prices of the products on the site and the shipping fees from time to time without the need for prior notice. The price in effect for an order is the price published at the time the order process is completed (including the provision of credit card details). If the prices are updated before completing the order process, the user will be charged according to the updated prices.
All product prices as they appear on the site are in New Israeli Shekels (ILS). Prices include VAT, if applicable by law, and do not include shipping fees.
The Operator may offer promotions, benefits, and discounts on the site. The Operator may, at any time, at its sole discretion, terminate, replace, or modify these promotions, benefits, and discounts without the need for prior notice, unless stated otherwise in the relevant promotion terms.
The terms of use of the site apply to the use of the site and the services included in it through any computer or other communication device (such as a mobile phone, handheld computer, etc.), as well as the use of the site through the internet or any other communication network.
Use of the Site
Any user is allowed to place orders and make purchases, subject to the cumulative conditions detailed below:
1. The user is legally competent to perform binding legal actions. 2. The user is over the age of 18 and has a valid email address. If you are a minor (under the age of 18) or not entitled to perform legal actions without the consent of a guardian, your use of the site will be considered as if you have received the guardian's approval. 3. The user has an Israeli ID or is a registered legal entity in Israel. 4. The user has a valid credit card issued by one of the active credit card companies in Israel.
The Operator reserves the right to prevent access to the site and/or parts of it to any user, including users who have previously used the site, at the sole discretion of the Operator without the need for prior notice, and without detracting from any other remedy available to it under any law.
The Operator may cease the operation of the site, in whole or in part, for a limited or indefinite period, reduce it and/or restrict it, all at its sole discretion without any prior notice.
Without detracting from the above, the Operator may prevent the use of the site by any user or the general public in any case where:
1. The terms of this agreement have been violated.
2. Inaccurate or incomplete information has been provided by the user.
3. An act or omission has occurred that may cause harm to the Operator and/or the site and/or the information on the site and/or other users.
3. Sales Process
For each product offered for sale (both in regular sales and public sales), a "Action Page" is displayed. The sales page includes the name of the product or service offered for sale, the price or service offered for sale, the shipping cost, and the total price including shipping fees (hereinafter: "Action Page"). In the case of a public sale, additional details will appear as detailed in section 4.2 below.
To place an order for a product, you must first choose the desired product, including size, color, and quantity. Then, you need to enter basic details such as name, address, email address, phone number, and credit card number (hereinafter: "Order Form"). The user then becomes an "Action Performer." To ensure a quick and smooth order process, it is important to provide accurate information; otherwise, the operator cannot guarantee the order's execution. If incorrect details are provided during the order process, and the products are returned to the operator due to misinformation, the action performer will be charged for shipping and handling fees. It is crucial to provide accurate and up-to-date information.
Upon completion of the action, the credit card details will be verified through the credit card company. After receiving approval from the credit card company and performing the CHECK OUT action by the action performer, a confirmation message will be sent, emphasizing that the order will be considered a purchase only after the operator receives confirmation from the credit card company regarding the payment, according to the existing procedures between the credit card company and the operator. Confirmation of the order execution will be sent to the email address entered by the action performer.
The operator is not responsible for any damage of any kind, direct or indirect, caused to the action performer or anyone on their behalf, if information entered on the website is lost, reaches an unauthorized party, and/or is used without authorization.
It is clarified and emphasized that the email delivery is not proof of an action and does not obligate the operator. Computer records of the operator's data processing, the computerized registration system of all actions on the website as mentioned, will serve as apparent evidence in them.
The charge for the action in relation to the cost of the purchased product or service will be made by credit card after completing the action.
Providing false information knowingly or without authorization may constitute a criminal offense. Against moral standards, false information may lead to civil and/or criminal legal actions, including claims for damages resulting from disruption of the sales process.
In case the transaction is not approved by the credit card company, the action performer will receive an appropriate notification. To complete the order and make the purchase, the action performer will be required to contact the customer service center of the operator by phone. It is clarified and emphasized that the order and purchase will be considered completed only after verification of credit card details and payment approval by the action performer and the credit card company. In such a case, delivery times will be counted only from the date of transaction approval by the credit card company. Without final approval from the credit card company regarding the order and purchase, the order will be canceled, and the operator will not be committed to the action performer in any way, including product retention in stock.
Approval of the order and purchase and the operator's commitment to delivery are conditional upon the product being actually available in stock at the operator's warehouses at the requested delivery time and/or at the time of the order. It should be emphasized and clarified that there may be cases where, even though a certain product is presented on the website as in stock, it is not actually in stock, and cannot be supplied. In such cases, the order will be canceled, and the action performer will have no claim and/or demand on this matter for any type of damage, whether direct or indirect, caused to him and/or to a third party, subject to the refund of the amount paid to the operator by the action performer as exclusive compensation.
4. Sales Method
Regular Sale
On the website, a list of products is displayed, including all the details about the product or service offered for sale and the price as predetermined. The sale through the website is until stock is depleted.
Completing the sales process is subject to approval from the credit company and the availability of the requested product in the warehouse of the online store when completing the sales process.
Public Auction
The public auction method is a sale in which products are offered for sale in a maximum quantity as determined by the operator, at the highest possible price.
In a public auction, the lowest price that can be offered for the purchase of the product ("Minimum Price") and/or the bidding increment by which an offer can be made above the minimum price ("Allowed Bidding Increment") will be displayed on the action page. It is not possible to offer prices lower than the minimum price or not in accordance with the allowed bidding increment.
It is clarified that the allowed bidding increment may change during the course of the public auction, all at the discretion of the operator.
In the public auction arena of the product, the participating customer can see the real-time offers of all other participants and add an additional amount to the highest bid (according to the allowed bidding increment). It is clarified that the addition will be in multiples of the allowed bidding increment only, as determined on the action page.
In case there are multiple identical offers at their highest, the offer submitted earliest will be selected.
In a public auction where only one unit of a product is offered, each participant may offer a price, provided it is higher than the minimum price as displayed on the action page. In a public auction where multiple units of the same product are offered, each bidder may offer the same price as the highest bid, according to the number of units offered for sale (or a higher price, according to the allowed bidding increment).
5. Delivery Times, Shipping, and Delivery
The operator will ensure the delivery of purchased products on the website to the address as entered on the action page, within the specified time on the action page of the product, unless explicitly stated otherwise. The operator will operate to deliver the products according to the delivery conditions specified on the action page, subject to full payment by credit card.
The operator will not be responsible for delays in product delivery in the following cases:
Force majeure, without prejudice to the above principles, war, hostile actions, a state of emergency, and natural disasters.
Suspension at the suppliers of services or goods required for the production and/or transportation of the products.
Any reason beyond the control of the operator.
In areas limited in access by the courier company, the operator and/or the courier company may deliver the products to customers in a nearby and acceptable location, in coordination with the customer.
The delivery times of the products and/or services as stated on the action page include only business days, Sunday to Thursday (excluding Friday, Saturday, holiday eves, and holidays).
Self-collection of the products can be done at one of the operator's branches. The customer will arrive at one of the operator's branches only after receiving a text message or email or phone call from the operator informing about the arrival of the product to the selected branch.
Delivery of the products is door-to-door by the courier company.
The term "shipping and delivery" in this regulation means all necessary actions from the moment the product is received from the supplier until it is actually delivered to the customer. These actions include receipt, sorting, packaging, marking, shipping, delivery, and insurance.
In case of a technical malfunction and/or technical failure on the website, the operator may cancel the orders placed and refund the purchaser in full.
Shipping Fees
Shipping fees will be paid by the purchaser as part of the payment for the product if shipping fees apply.
It is agreed that in the case of self-collection of the products by the purchaser as mentioned in clause 5.5 above, no shipping fees will be charged to the purchaser.

7. Cancellations and Exchanges
The provisions in this regulation are subject to the Consumer Protection Law, 1981 (hereinafter: "the Law") and its regulations. In any case of contradiction and/or inconsistency between the provisions of this regulation and the provisions of the law, the provisions of the law shall prevail.
Cancellation of a transaction will be made by sending a cancellation notice (hereinafter: "Cancellation Notice") in one of the following ways:

The user may cancel the purchase transaction on the website in accordance with the provisions of the law and receive a refund, subject to the following:
The user may cancel the purchase transaction from the day of its execution until 14 days from the date of receiving the products or from the date of receiving the document containing the details specified in section 14g(b) of the law (whichever is later). However, a user who is a person with a disability, a senior citizen, or a new immigrant, as defined in these terms, may cancel the purchase transaction within 4 months from the day of its execution, from the date of receiving the transaction document or from the date of receiving the document containing the details specified in section 14g(b) of the law, whichever is later, provided that the transaction included a call between the website representatives and the user, including a call through electronic communication. In this section: "Person with a disability" – as defined in the Equal Rights for Persons with Disabilities Law, 1998; "Senior citizen" – a person who has reached the age of 65; "New immigrant" – a person who has not yet completed five years from the date of receiving an immigrant certificate or a certificate of entitlement.
If a user requests to cancel a transaction and is a person with a disability, a senior citizen, or a new immigrant, the website representatives may request him to present proof that he is a person with a disability, a senior citizen, or a new immigrant. In accordance with the request, the user will present to the website representatives one of the documents specified in section 14g1(d) of the law, as applicable, or provide them with a copy, including through electronic communication.
Once the user has received the cancellation notice, he shall make the products available to the operator at the place where they were delivered and inform the operator accordingly. The user must ensure that the product is returned in its original packaging (including labels) and without any damage or defect of any kind.
A refund will be made through a credit card refund or in the manner in which payment was made (whichever is applicable), and not later than 14 days, subject to compliance with the law requirements.
In the event that a user cancels a transaction according to the provisions of this regulation due to a defect in the purchased product, inconsistency between the purchased product and the details provided to him according to section 14g(b) of the law, or due to non-delivery of the purchased product within the specified period by the operator or due to any other breach by the operator of the sales conditions, the operator may, at its discretion, charge a cancellation fee in an amount not exceeding 5% of the purchase price of the product or 100 new shekels, whichever is lower. The user will specify his name and ID number in the cancellation notice.
Exchange and/or credit and/or return will not be allowed for a single item purchased as part of a set.
Exchange and/or credit and/or return will not be allowed for a product that is specially made for the consumer according to specific measurements and requirements (e.g., in the case of purchasing a shirt with a name and/or number that does not appear in the catalog on the website).
8. Cancellation of Purchase by the Operator due to Site Shutdown
In any case where, due to force majeure, it becomes necessary for the operator to manage the site properly, provide the products, or fulfill other commitments, the operator is entitled to cancel communication with users, all or some of them.
If there are changes in tax rates and/or levies applicable to the products and/or services between the time of product publication and/or purchase on the site and the planned delivery date according to the product and/or service purchase conditions, the operator is entitled to cancel communication with users, all or some of them, and/or to cease site activity.
Without detracting from the above, if after completing an order and purchase, it is discovered that the product is out of stock, the operator is entitled to cancel the purchase transaction or offer an alternative product of equal value.
In the event of an error in the description of the product and/or service, its price, payment terms, product image, or any other printed material or information received from the user, the operator may cancel the specific purchase transaction and refund the customer the actual amount paid.
9. Responsibility and Service
The operator is not responsible and shall not bear any direct, indirect, consequential, or special damages caused to the user and/or any third party as a result of using or purchasing through the site, except according to this regulation – the cause of the claim shall be, including loss of income and/or prevention of profit caused by any reason.
In any case, the operator shall not assume any responsibility exceeding the value of the purchased product, as well as for any non-direct damage.
The operator is not responsible for any use by the user that does not comply with the manufacturer's and/or operator's instructions, including laundry and/or any other use of the products sold through the site.
The site management will do its best to provide quality products on the requested date. If the user believes that the product purchased through the site or the services are defective in any way, they are invited to contact customer service at 058-767-1117 or via email: shop@brothers1906.org, and the operator will address the inquiry as soon as possible.
10. Intellectual Property
All intellectual property rights in the operator, including patents, copyrights, designs, methods, and trade secrets, are the exclusive property of the operator. These rights include, among other things, the graphic design of the operator's website, its database (including product lists, product descriptions, etc.), the site's computer code, its internet address, and any other details related to its operation.
It is prohibited to copy, duplicate, distribute, sell, market, or translate any information from the site (including trademarks, images, texts, and computer code) without the explicit written permission of the operator.
The name of the operator and the brand name (Achim LeSiml), the trademarks of the operator (whether registered or not) – all belong exclusively to the operator. Their use is prohibited without the prior written consent of the operator.
Icons, information, and/or displays appearing on the site, including graphics, design, verbal presentation, trademarks, logo symbols, and the editing and display of these, are the exclusive property of the operator. Any use of this property of the operator will be in accordance with the provisions of this regulation only.
No use should be made of any trademark or design of a product or model appearing on the site or in photographs on the site, which is the intellectual property of the operator.
11. Policy Regarding User Privacy
As the operator respects the privacy of users on the website, it has decided to publish its policy regarding privacy protection on the site, and it is committed to adhering to this policy towards the user. The purpose of the policy is to explain the operator's practices regarding the privacy of users on the site and how the operator uses information provided by users on the site or collected by it during the use of the site.
During the use of the site's services, information about you is collected. Some of the information personally identifies you, such as your name and address, payment methods used by you, and so on. This is the information you provide knowingly and voluntarily, for example, when registering on the site. Some of the information does not personally identify you and is not stored together with your details. Use of Information. The use of collected information will only be done in accordance with this privacy policy or according to the provisions of any law, in order to:

Improve and enrich the services and content offered on the site;
Modify or cancel existing services and content;
For the purpose of purchasing products, including publishing information and content;
To customize ads displayed during site visits to your areas of interest.
To provide users with messages regarding the services provided and/or offered by the operator and/or on its behalf.
To provide support and service to users, by the operator and/or through third parties.
The information that will serve the operator will primarily be statistical information that does not personally identify. The operator is authorized to disclose non-personal information to third parties at its discretion.
Disclosure of Personal Information to Third Parties. The operator will not transfer your personal details and the information collected about your activity on the site to third parties except in the cases detailed below:
In the case of a legal dispute between you and the operator that requires disclosure of your details;
If you perform actions on the site that violate the law, including to disclose, prevent, or address any other form of fraud, or security issues;
To comply with any law in response to a legal process, disclosure order, or request from a governmental authority;
With your explicit consent before disclosure.
Cookies. The operator's website uses "cookies" for ongoing and proper operation, including collecting statistical data about the use of the site, verifying details, customizing your personal preferences, and for information security purposes. Modern browsers include an option to prevent the acceptance of cookies. If you do not know how to do this, check the help file of the browser you are using.
Information Security. The operator implements up-to-date systems and procedures for information security on its sites. While these systems and procedures minimize the risks of unauthorized access, they do not provide absolute security. Therefore, the operator does not undertake that its services will be completely immune from unauthorized access to the information stored in them.
Right to Review Information. According to the Privacy Protection Law, 5741-1981, every person is entitled to review the information held about him in an information database. A person who reviews the information about him and finds that it is incorrect, incomplete, unclear, or not up-to-date may contact the database owner in writing to correct or delete the information. In addition, if the information in the operator's databases is used for personal contact with you, you are entitled, according to the Privacy Protection Law, 5741-1981, to demand in writing that the information referring to you be deleted from the information database.
Changes to the Privacy Policy. In any case where substantial changes are made to this policy regarding the use of personal information that you have provided, notice of this will be published on the homepage of the site.
12. Additional Terms
The operator is not responsible for the content published in links on the site leading to other websites, as long as there are such links. The operator does not undertake that the link will lead the user to an active internet site.
The interpretation and enforcement of this policy and/or any action or dispute arising from it will be in accordance with the laws of the State of Israel and will be clarified, if necessary, in the Tel Aviv-Jaffa District Court.
Unless otherwise stated, any mention of the operator in this policy includes the Brothers Association for Symbol, including its related entities, its shareholders, its officeholders, and those acting on its behalf.
